TERMS OF USE
We welcome you to Dazl. These Terms of Use are between you and us:
1. Acceptance of the Terms of Use Agreement.
By creating an account on Dazl, whether through a mobile device, mobile application or computer (collectively, the “Service”) you agree to be bound by:
(i) these Terms of use, (ii) our Privacy policy and Cookie policy, our Safety tips and to our Community rules, each of which is incorporated by reference into this Agreement, and (iii) any terms disclosed to you and accepted by you if you purchase any additional features, products or services we offer through the Service ( collectively, this “Agreement”). If you do not accept or agree to be bound by all of the terms of this Agreement, please do not use the Service.
From time to time we may make adjustments to this Agreement and our Service. This may be for a variety of reasons, including the need to reflect changes in legislation, incorporate new functionality, or adapt to updated business practices. The most recent version of the Agreement will always be available in the "Settings" section of our Service, as well as at www.Dazl.app
We recommend that you regularly review the most current version to stay informed. If the changes include significant modifications to your rights or obligations, we will notify you at least 30 days in advance (unless applicable law prohibits us from doing so) through reasonable means, such as a notice on the Service or by email. Your continued use of the Service after the changes become effective will constitute your acceptance of the updated Agreement.
2. Eligibility.
You are not authorized to create an account or access or use the Service or the systems on which it resides unless the following conditions are met:
- Be at least 18 years of age.
- You can form a binding contract with Dazl.
- You will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations.
- Has never been convicted of a serious crime or an actionable crime (or crime of similar seriousness), a sexual crime, or any type of crime involving violence, and is not required to register as a sex offender on any state registry , federal or local sex offender.
3. Your account.
To use Dazl, you can log in with your email, we may later add other registration options, via SMS message verification code. For more information regarding your privacy visit the page Privacy Policy
You are responsible for maintaining the confidentiality of the access credentials you use to register with Dazl and are solely responsible for all activities that occur under those credentials. If you believe that someone has gained access to your account, contact us immediately.
4. Modification of the Service and cancellation
Dazl is always committed to improving your experience and providing you with additional functionalities that are attractive and useful. To achieve this, it may be necessary to add or remove features or update products from time to time. If these changes do not materially affect your rights or obligations, you may not receive prior notice. In exceptional situations, we may also have to discontinue the Service entirely, in which case we will notify you in advance, unless circumstances such as security issues prevent us from doing so.
If you wish to delete your account, you may do so at any time by following the instructions available in the "Settings" section of our Service. However, if you have made purchases through a third-party account, such as the App Store or Google Play Store, you will need to manage these purchases through that account to avoid additional charges. Dazl may also terminate your account at any time without notice if it believes that you have violated the terms of this Agreement. In that case, you will not be entitled to any refund for purchases made.
After you cancel your account, this Agreement will terminate, with the exception of the following provisions which will remain valid for both parties: Section 4, Section 5, and Section 12
5. Security and your interactions with other users.
Although Dazl aims to encourage a respectful user experience by allowing users to communicate with each other only when both have indicated that they have an interest in each other, Dazl is not responsible for the conduct of any user on or off the Service. You agree to exercise caution in all interactions with other users, especially if you decide to communicate with them outside of the Service or meet them in person. Additionally, you agree to review and follow Dazl's Security Tips before using the Service. You agree not to provide your financial information (for example, your credit card or bank account) or electronically transfer or otherwise send money to other users.
6. Rights that Dazl grants you.
Dazl grants you a personal, worldwide, royalty-free, non-assignable and non-exclusive, revocable, non-sublicensable license to access and use the Service. This license is granted for the sole purpose of enabling you to use and enjoy the benefits of the Service as intended by Dazl and permitted by this Agreement. This license and any authorization to access the Service will automatically be revoked in the event that you commit any of the following actions:
• Use the Service or any content on the Service for commercial purposes without our written consent.
• Copy, modify, transmit, create derivative works from, make use of, or reproduce in any way any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content or proprietary information. access through the Service without the prior written consent of Dazl.
• Do not express or imply that any of your statements are endorsed by Dazl.
• Use any robot, spider, crawler, site search/retrieval application, proxy or other manual or automatic device, method or process to access, retrieve, index, “data mine”, or in any way reproduce or circumvent the structure of navigation or presentation of the Service or its content.
• Use the Service in any manner that could interfere with, disrupt, or adversely affect the Service or the servers or networks connected to the Service.
• Upload viruses or other malicious code or compromise the security of the Service.
• Forge headers or manipulate identifiers in order to disguise the origin of any information transmitted through the Service.
• “Frame” or “mirror” any part of the Service, without the prior written authorization of Dazl.
• Use meta tags or code or other devices containing any reference to Dazl or the Service (or any Dazl trademark, trade name, service mark, logo or slogan) to direct any person to any other site for any purpose.
• Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or disassemble any part of the Service, or cause others to do so.
• Use or develop any third-party application that interacts with the Service or the Content or information of other users without our written consent.
• Do not use, access or publish the programming interface of the Dazl application without our written consent.
• Probe, scan or test the vulnerability of our Service or any system or network.
• Not encourage or promote activities that violate this Agreement.
Dazl may investigate and take appropriate legal action in response to illegal and/or unauthorized uses of the Service, including deletion of your account.
Any software we provide to you may automatically download and install updates, upgrades, or other new features. You may be able to adjust these automatic downloads through your device settings.
7. Rights that you grant to Dazl.
By creating an account, you grant Dazl a worldwide, transferable, sublicensable, royalty-free right and license to organize, store, use, copy, display, reproduce, adapt, edit, publish, modify and distribute information to which you authorize access, as well as any information that you post, upload, display or otherwise make available (collectively, "postings") on the Service or transmit to other users (collectively, "Content").
Dazl's license to your Content will be non-exclusive, except that Dazl's license is exclusive with respect to derivative works created through the use of the Service. For example, Dazl would have an exclusive license to images from the service that include your Content. Additionally, to enable Dazl to prevent use of your Content outside of the Service, you authorize Dazl to act on your behalf with respect to infringing uses of your Content obtained through the Service by other users or third parties. This expressly includes the power, but not the obligation, to provide notices in accordance with 17 U.S.C. § 512(c)(3) (i.e., DMCA Takedown Notices) on your behalf if your content is taken and used by third parties outside of the Service.
Our license to your Content is subject to your rights under applicable law (for example, data protection laws to the extent any Content contains personal information as defined by such laws) and is for the purpose limited operation, development, provision and improvement of the Service, as well as for the research and development of new ones. You agree that any Content you place or that you authorize us to place on the Service may be viewed by other users and may be viewed by anyone who visits or participates in the Service (such as persons who may receive Shared Content from other users of the Service). You agree that all information you submit when creating your account is accurate and truthful and that you have the right to post the Content on the Service and grant the above license to Dazl.
You understand and agree that we may monitor or review any Content you post as part of a Service. We may remove any Content, in whole or in part, that in our judgment violates this Agreement or may damage the reputation of the Service.
In consideration of Dazl allowing you to use the Service, you agree that we, our affiliates, and our third-party partners may place advertising on the Service. By sending suggestions or comments to Dazl regarding our Service, you agree that Dazl may use and share such feedback for any purpose without compensating you for it.
Under this Agreement with you, you should be aware that Dazl may access, store and disclose your account information and Content if required to do so by law, or in good faith belief that such access, storage or disclosure satisfies a public interest. legitimate, such as to: (i) comply with legal processes; (ii) enforce the Agreement; (iii) respond to claims of Content that may violate the rights of third parties; (iv) respond to your requests from the customer service department; or (v) protect the rights, property or personal safety of the Company or any other person.
8. Community rules.
By using the Service, you agree not to:
• Use the Service for purposes that are unlawful or prohibited by this Agreement.
• Use the Service for any harmful or perverse purpose.
• Use the Service in order to cause damage to Dazl.
• Violate our Community Rules , which are updated from time to time.
• Spam, request money from, or defraud any user.
• Impersonate any person or entity or post any image of another person without their permission.
• Bully, “stalk”, intimidate, attack, harass, mistreat or defame any person.
• Post any Content that violates or infringes the rights of any person, including rights of publicity, privacy, copyright, trademark or other intellectual property or contract right.
• Post any content that contains hate speech, threatening, sexually explicit or pornographic speech.
• Post any content that incites violence; or that contains nudity or graphic or unnecessary violence.
• Post content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.
• Solicit passwords for any purpose, or personal identification information from other users for commercial or unlawful purposes, or disseminate another person's personal information without their permission.
• Use another user's account, share an account with another user, or have more than one account.
• Create another account if we have already canceled your account, unless you have our permission.
Dazl reserves the right to investigate and/or delete your account without refund of purchases made if you have violated this Agreement, if there has been misuse of the Service or you have behaved in a way that Dazl considers inappropriate or illegal, including actions or communications that occur outside or inside the Service.
9. Content from other users.
Although Dazl reserves the right to review and remove Content that violates this Agreement, such Content is the sole responsibility of the user who posts it, and Dazl cannot guarantee that all Content will comply with this Agreement. If you see Content on the Services that violates this Agreement, please notify us within the Services or through our contact form.
10. Shopping
Generally. From time to time, Dazl may offer purchase products and services (“in-app purchases”) through the App Store, Google Play Store, carrier billing, Dazl direct billing or other payment platforms authorized by Dazl. If you decide to make an in-app purchase, you will be asked to confirm your purchase with the applicable payment provider, and your payment method (either your card or a third-party account such as the Google Play Store or App Store) will be charged ( your "Payment Method") for your in-app purchase at the prices shown to you for the services you have selected, as well as any sales or similar taxes that may be imposed on your payments, and you authorize Dazl or the third party account, as applicable, may charge you.
Automatic Renewal - Automatic Card Payment
If you purchase a recurring subscription that pays automatically within the app, your Payment Method will continue to be billed until you cancel it. After the initial subscription period you have committed to, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing. Card payment information will be stored and subsequently used for automatic card payments in accordance with the Agreement.
Objections to a payment already made should be directed to Customer Support if you have been billed directly by Dazl or the applicable third-party account, such as the App Store. You can also make a payment objection by contacting your bank or payment provider, who will be able to provide more information about your rights, as well as any applicable deadlines. You can unconditionally withdraw your consent to automatic card payments at any time by going to the Settings section of Dazl or in the applicable third-party account, but please note that you will still be obligated to pay any outstanding amounts.
If you wish to change or cancel your subscription, you will need to log into your third-party account (or Settings in Dazl, if applicable) and follow the instructions to cease or cancel your subscription, even if you have deleted your account with us or if you have deleted the Dazl app from your device.
Deleting your account on Dazl or deleting the Dazl app from your device does not terminate or cancel your subscription; Dazl will retain all funds credited to your Payment Method until you cease or cancel your subscription to Dazl or the third party account, as applicable. If you cease or cancel your subscription, you may use your subscription until the end of your then-current subscription period and your subscription will not be renewed after such period ends.
Additional terms that apply if you pay Dazl directly with your Payment Method.
If you pay Dazl directly, Dazl may correct any errors or omissions in billing, even if you have already requested or received payment. If you initiate a collection dispute or otherwise reverse a payment made with your payment method, Dazl may terminate your account immediately at its sole discretion.
To edit your Payment Method information, visit Dazl and go to Settings. If a payment is not completed successfully, due to expiration, insufficient funds, or any other reason, and you do not edit your Payment Method information or cancel your subscription, you will remain responsible for any uncollected amounts, and you authorize us to continue billing to your Payment Method, which can be updated
This could result in a change to your billing dates. Additionally, you authorize us to obtain updated or replacement expiration dates and card numbers for your credit or debit card as provided by the issuer of your credit or debit card. Payment terms will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of the Payment Method you have chosen.
Refunds.
Purchase charges are generally non-refundable and no refunds or credits are given for partially used periods. We may make an exception if a refund for a subscription offer is requested within fourteen days of the transaction date, or if applicable laws in your jurisdiction provide for refunds.
Subscribers residing in the EU or the European Economic Area, in accordance with local law, are entitled to a full refund without giving any reason within 14 days after the start of the subscription. Please note that this 14 day period begins when the subscription is started.
To request a refund:
If you made purchases using your Apple ID, refunds will be handled by Apple, not Dazl. To request a refund, go to the App Store, click your Apple ID, select “Purchase History,” find the transaction, and click “Report a Problem.” You can also submit a request here
If you made a purchase using your Google Play Store account or directly through Dazl, please contact customer service with your Google Play Store order number (the number is located in your order confirmation email or in the Google Wallet site) or Dazl (you can find it in your confirmation email).
You may also mail or personally deliver a signed and dated notice stating that you, the buyer, are canceling this agreement, or words of similar effect. Please also include the email address or mobile phone number associated with your account in addition to your order number.
If you exercise your right to cancel (except for purchases made through your Apple ID, which Apple controls), we will refund (or ask Google to refund) all payments received from you, without undue delay and in any event within 14 days of the date on which we receive notification of your decision to cancel the Agreement.
If you made a purchase through a payment gateway not listed above, please request a refund directly from the third-party seller through which you made your purchase.
Price fixing.
Dazl operates a global business and our prices vary according to a number of factors. We frequently offer promotional rates, which may vary by region, subscription length, package size, and more. We also regularly test new features and payment options.
11. Disclaimers
DAZL offers the service "as is" and according to availability. MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE ABOUT THE SERVICE (INCLUDING ALL CONTENT THEREOF), WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF Satisfactory Quality, Merchantability, Fitness For A Particular Purpose Or Not. infringement. DAZL does not warrant that the service will be uninterrupted, secure or error-free, that errors in the service will be corrected, or that the content or information obtained through the service is accurate.
DAZL is not responsible for any content that you or any other user or third party posts, sends or receives through the service. You access any material downloaded or otherwise obtained through the use of the service at your own discretion and risk.
12. Limitation of liability.
To the maximum extent permitted by applicable law, neither DAZL nor its affiliates, employees, licensors or service providers will be liable for any indirect, consequential, illustrative, incidental, special, punitive or amplified damages, including, without limitation, loss of profits, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of the Service, or your inability to access or use the Service; (ii) the conduct or content of other users or third parties during or after use of the service; or (iii) unauthorized access, use or alteration of its content, even if DAZL has been advised of the possibility of such damage. In no event will DAZL's total liability for all claims related to the Service exceed the amount paid by you to DAZL for the Service, plus $100 while you have an account.
Certain jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the exclusions and limitations in this section may not apply to you.
13. Entire Agreement and Others.
This Agreement includes the Privacy Policy, Cookie policy, Security tips and Community Rules as it is the entire agreement between Dazl and the user regarding the use of the Service. Any invalid provision will not affect the rest of the agreement. Dazl does not waive its rights if you do not exercise them, and the Dazl account is not transferable. This agreement does not create an employment relationship nor does it allow the user to represent Dazl.
